Delivery firm 3663 Limited was asked to pay £7,000 to an employee as compensation when he broke his index finger on the job.

A driver with the firm, David McCulloch was delivering bread buns to Burger King in Newmarket when his hand got trapped in the van’s door. The door was a faulty one and the Burger King employees were not able to free his hand from the door. The fire department was called and they were successfully able to do so using special cutting equipment. This left David with a broken index finger and he had to take off seven weeks from work.

After the incident, workers’ union GMB suggested that he take up a compensation claim against the firm with the help of Thompsons Solicitors. His firm admitted responsibility of the incident and the matter was settled outside of court.

David said that being a driver, his hands are the main source of his income, and that he was glad that his injuries were not more serious. He however did change jobs and now works for some other company as a driver.

Carol Sears from GMB added that the firm was completely at fault and David should not have been made to work in a situation where equipment was not functioning properly. She added that he had to endure a tough time as a result of the firm’s negligent behaviour. A course in the management of health and safety (NEBOSH training) could help to cut the risks that apply in the workplace.

In this respect, Martin Fell from Thompsons Solicitors said that David was a victim of his firm’s incompetence in meeting the standards of safety at work. He also said that the company should have conducted a thorough examination of all its vehicles used by workers to prevent such accidents.
